Notification of Copyright Infringement

TV Plus stream is an online service provider as defined in the Digital Millennium Copyright Act. We provide legal copyright owners with the ability to self-publish on the Internet by searching, embedding and and displaying (NOT STREAMING!) various types of media. We take copyright violation very seriously and will vigorously protect the rights of legal copyright owners.

Counter Notification of Copyright Infringement

  2. To file a Counter Notification with us, you must send us an e-mail that sets forth the items specified below:
    1. Identify the specific message ID(s) of material that we have removed or to which we have disabled access.
    2. Provide your full name, address, telephone number, and e-mail address.
    3. Provide a statement that you consent to the jurisdiction of Federal District Court for the judicial district in which your address is located (or Winter Park, FL if your address is outside of the United States), and that you will accept service of process from the person who the provided notification of claimed infringement to which your notice relates or an agent of such person.
    4. Include the following statement: ā€œI swear, under penalty of perjury, that I have a good faith belief that the material was removed or disabled as a result of a mistake or misidentification of the material to be removed or disabled.ā€
    5. Sign the notice. If you are providing notice by e-mail, an electronic signature (i.e. your typed name) or scanned physical signature will be accepted.
  3. If we receive a Counter Notification from you, we may forward it to the party who submitted the original Notification of Claimed Infringement. The Counter Notification we forward may include some of your personal information, such as your name and contact information. By submitting a Counter Notification, you consent to having your information revealed in this way. We will not forward the Counter Notification to any party other than the original claimant unless required or expressly permitted to do so by law.

After we send out the Counter Notification, the original claimant must respond to us within 10 business days stating he or she has filed an action seeking a court order to restrain you from engaging in infringing activity relating to the material on our web site.

It is our policy, in what we deem in our sole discretion to be appropriate circumstances, to disable and/or terminate the accounts of users, subscribers or account holders who repeatedly infringe the copyrights or other intellectual property rights of others or of TV Plus stream.

A user, a subscriber, or an account holder will have their accounts disabled or terminated indefinitely by TV Plus Stream if they consistently violate the copyrights and/or other intellectual property rights of others or TV Plus Stream.

  • Waiver of Responsibility and Liability

The Organization has signed a liability waiver on behalf of the Participant. The Participant hereby acknowledges that he/she has read and fully understood the terms of this Waiver.

9.1. Assumption of Risk

The Participant agrees and understands that he/she is taking part voluntarily in the activity, event, and program conducted by the Organization. As such, the Participant knows, accepts, and understands that the activity, event, or program might pose some risk, such as bodily harm, property damage, etc. By participating in this program, The Participant understands they are doing so entirely at their own risk.

9.2. Waiver of Liability

Considering there was an opportunity for participation in the activity, event, or program by the participants, the Participant on behalf of him/herself, his or her personal administrators, administrators, heirs, and next of kin, now or in the future, releases and discharge the Organization, its officers, directors, employees, agents, and any associated partners or affiliates from any and all claims, demands, actions, or causes of action, whether in Law or equity, arising from any act, omission, or negligence of the Organization or any third party.

9.3. Indemnification

Indemnity defends and saves the Organization from any liability, loss, damage, or expense, including the legal fee against the actions resulting from the Participantā€™s involvement in an activity, event, or program.

9.4. No Responsibility for Personal Property

The Organization shall not be held liable when there is a loss, theft, or damage of any personal property or possession the Participant will experience while participating in the activity, event, or program.

9.5. Compliance with Rules and Instructions

During the activity, event, or program, the Participant undertakes to observe all the Organizationā€™s and its agentsā€™ requirements.

9.6. Governing Law

The Waiver shall be interpreted and applied within the provisions of laws for the state or jurisdiction where the Organization is sited.

9.7. Severability

In case any provision is not enforceable or invalid, it should only be excluded from the entire Waiver, leaving the remainder intact in full operation.

  • General Notice

We do not guarantee compensation in any way due to a malfunction of your system or hardware resulting as a consequence of accessing the information published on our web page.
